These Terms of Service govern your access to and use of the HoistChecker platform, website and mobile applications (the "Service"), operated by TWSA ("we", "us"). By using the Service you agree to these Terms.
1. Use of the Service
HoistChecker is a vehicle lift compliance management tool that helps you record and manage inspections of vehicle hoists. You are responsible for the accuracy of the data you enter and for ensuring inspections are carried out by competent persons in accordance with applicable standards, including AS 2550.9, and any workplace health and safety obligations that apply to you.
2. Accounts
You must provide accurate account information and keep your login credentials secure. You are responsible for all activity under your account and must notify us promptly of any unauthorised use.
3. Compliance disclaimer
HoistChecker is a record-keeping and reporting tool. It does not certify equipment, perform inspections, or replace the judgement of a qualified inspector. Compliance with AS 2550.9 and all safety obligations remains your responsibility. We do not warrant that use of the Service guarantees compliance.
4. Subscriptions and add-ons
Access to certain features may require a paid subscription or add-on module, enabled per account. Fees, where applicable, are as agreed with you.
5. Your data
You retain ownership of the data you submit. We handle personal information in accordance with our Privacy Policy, and may use aggregated, de-identified data to improve the Service.
6. Availability
We aim to keep the Service available but do not guarantee uninterrupted access, and may update, suspend or discontinue features from time to time.
7. Limitation of liability
To the maximum extent permitted by law, and subject to any rights you have under the Australian Consumer Law that cannot be excluded, TWSA is not liable for any indirect or consequential loss arising from your use of the Service.
8. Changes
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
